Tour Conditions

By booking a tour with Travel Lemming, you are agreeing to these Tour Conditions, as well as any Trip-Specific Conditions as separately set out in the Trip Documents for your specific tour. Please read these documents carefully before booking a tour.

I. Our Contract & Your Third Party Operator Trip

When you book a tour with Travel Lemming (“us / we“), we are acting as an agent who obtains tours (“Trip Services,” or “Tours“) for you from a licensed third-party travel operator (“Operator“). Any additional services we provide for you are ancillary to that agency relationship. Our obligation to you is to provide travel advisory services and make tour bookings on your behalf (“Travel Booking Services“). You pay us for providing Travel Booking Services, and allow us to collect and retain payment. The terms of our agency relationship are governed by these Tour Conditions.

Travel Lemming does not directly provide travel services, and by booking with us you acknowledge and and agree that we have no control over, or liability for, the services provided to you by the Operator. All Travel Booking Services are subject to any conditions, waivers, or limitations of liability imposed by the Operator. We will provide you with copies of our Operator terms and conditions for your tour upon request.

1(a). All Itineraries Are Subject to Change

All Tour itineraries are subject to change without notice. Travel involves many components that can change at a moment’s notice for a variety of reasons. Therefore, Operators must to maintain flexibility to change itineraries if necessary.

Uncompleted portions of an itinerary are not subject to a refund.

1(b). Acceptance of Risk and Waiver of Liability

You will be required to review and accept a General Release and Waiver Agreement prior to beginning the tour. Failure to accept all or part of the agreement is grounds for expulsion from the Tour at your own expense.

You acknowledge that your Tour involves a degree of risk, and you accept liability for all potential risks of traveling, including but not limited to bodily injury or harm, mental or emotional distress, and loss, damage, or theft of personal property.

You specifically agree to release from all liability Travel Lemming, its employees or agents, as well as Tour Operators.

You further acknowledge that you may be visiting a place where local politics, culture, and geography presents challenges more significant than those present in your daily life.

You also further acknowledge that you are traveling during a time and place where you may be exposed to the COVID-19 virus, or other communicable diseases. It is your own responsibility to manage all health risks. By attending the Tour, you acknowledge you have made a decision to fully accept these risks.

You further understand and agree that all Tours are group tours, and that you will be traveling with other tour participants. You agree that we will not be held liable for any alleged improper actions or misconduct of other tour participants.

Because we provide you with Travel Booking Services only, we are liable in accordance with these terms and conditions for any breaches of our obligations in providing the Travel Booking Services to you. We are not otherwise liable to you or anyone else for negligence, breach of contract or tort, loss or any other damages.

II. Tour Forms, Obligations, and Risks

You are responsible for getting yourself to and from the tour start point.

II(a). Passports and Visas

It is your responsibility to get yourself to the tour start point. This means you are responsible for ensuring you have the proper passports, visas, or other documents required to travel to your destination. You understand that many countries require your passport to have at least 6 months of validity past the end date of your planned trip. Other countries may required other documents for entry, such as proof of return travel or certain vaccination records. We are not liable if you are not accepted into the destination country by immigration, and it will not be grounds for a refund.

II(b). Travel Insurance

Travel insurance is mandatory and must be taken out at the time of booking, except where required otherwise by law (in which case, it is strongly recommended). You are responsible for selecting, buying, and securing your own travel insurance. It is your sole responsibility to make sure you have adequate insurance, including but not limited to emergency medical services, emergency evacuation, and trip cancellation and interruption.

II(c). Photo Release

By traveling with us, you consent to images taken of you being used for advertising and promotional purposes, and grant us a perpetual, royalty-free, irrevocable license to use such images. You can revoke this consent up until the Tour start date, if you do not want images of you used in our marketing materials, by writing us at [email protected].

II(d). “Be Kind” Conduct Policy

Group Tours involve interaction with other participants, and you agree to be kind to all participants. We seek to foster a culture of inclusivity and respect. We ask you to exercise discretion and avoid remarks that may be deemed offensive by a person of a different identity or background.

If you are asked to leave a tour for bad behavior or disruptive action, you will not receive a refund and are responsible for any resulting expenses incurred to leave the tour.

II(e) COVID-19 Policy

Tours follow local health policies. We do not require proof of vaccination, but we do strongly encourage it and some localities or attractions may have different health, vaccination, or testing rules, which you are responsible for complying with.

If you contract COVID-19 or another communicable disease while on the tour, for the safety of other participants we reserve the right to ask you to leave the tour at your own expense. You acknowledge this possibility, assume this risk, and further acknowledge that is your responsibility to obtain travel insurance or other protection for this scenario.

II(f). Compliance with Local Laws and Customs

Some of our Tours may take you to a foreign country with different local laws, customs, and practices than you may be used to.

You are fully responsible for complying with all local laws.

III. Deposits, Refunds & Cancellations

When you book a tour, we will collect a deposit. The remaining balance must be paid in accordance with the timing set out in the Trip-Specific Conditions of your Trip Documents (“Final Payment Date“). You must pay your remaining balance by the Final Payment Date to attend the Tour.

All payments, including deposits, are:

  • 100% refundable, minus any credit card processing fees, up to 60 days before the Tour’s departure date;
  • 50% refundable, minus any credit card processing fees, until 45 days before the Tour’s departure date;
  • Non-refundable less than 45 days before the Tour’s departure date.

Note that we do not refund credit card processing fees. Credit card processing fees are fees we must incur to facilitate payment through payment gateways, and we cannot get them back from the processor. Credit card processing fees vary base upon the payment method you select, but typically run about 3% of the transaction amount.

No shows are not entitled to a refund.

Refund requests should be made to [email protected].

If your refund request is in compliance with the above policy, we will process it within 10 business days. It may take additional time for the processor and your bank to reflect it in your account. Refunds are sent via the original form of payment.

III(a). Price Changes

All prices are in US dollars. Published prices may vary based upon market conditions at any point up to your departure. When you book a Tour, the price you agree to is the price you will pay, regardless of future published prices for the same tour.

III(b). Tour Cancellation or Postponement

We make every effort not to cancel Tours, but on rare occasions we may have to cancel or postpone a Tour. We require a minimum number of participants to run each Tour, and reserve the right to cancel the Tour and refund your money for this reason until 90 days before a tour begins.

III(c). Act of God or Force Majuere

We do not assume any liability for, any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other force majeure condition, including, but not limited to: war; riot; blockade or embargo; strikes or labor disruptions; explosion; acts of terrorism; insurrection; sabotage; arrests; government seizures; acts of God; fire; flood; earthquake; volcanic eruption; hurricane; environmental pollution or contamination; low or high water levels; water or power shortages or failures; tropical storms; inclement weather; windstorm; other extreme weather event; epidemic; quarantine restriction; government health advisory, pandemic; other health emergency; passage of any law, order, proclamation, regulation, ordinance, demand, requisition or requirement or any other act of any government authority, beyond the reasonable control of the parties, whether or not foreseeable, which would make it dangerous or not viable for a trip to commence or continue. In the circumstances amounting to force majeure, we will not be required to refund any money to you.

IV. Age and Medical Restrictions

Our tours are for adults aged 18+, or who will be 18 by the start of the tour.

All travelers need to be in good physical health to fully participate in the trip. For the safety of others, if you are unwell prior to traveling, please stay home. When selecting a Tour, please make sure you read the itinerary carefully and assess whether the activities listed are within your physical abilities to participate in and enjoy.

By purchasing our Travel Booking Services, you further acknowledge this policy and that you are 18 years of age or older.

V. Arbitration, Governing Law, & Severability

All disputes arising out of or in connection with the present contract shall be finally settled under the Rules of Arbitration of the International Chamber of Commerce by one or more arbitrators appointed in accordance with the said Rules.

This contract shall be governed by the laws of the United States and Colorado.

The terms of these Tour Conditions are independent and severable, and if any part of this agreement is found to be prohibited or unenforceable, the remainder shall survive.
